bug Posted June 23, 2008 Report Share Posted June 23, 2008 I have to wonder why Shetland get more odd characters per head of population than any where else in the world maybe it is something in the water Para Handy, joost tink - Forvick has 100% OC's per capita - soorly a world record in itsell an far more worthy of national press coverage. On a more serious note I wid lik a few questions answered - 1. If 1 Forvick Gulde = £55 UK will we see the exchange rate quoted on the markets so we can choose the best time to invest in our square metre of Forvick? 2. When I buy my plot can I start drilling for oil straight away or do I have to seek permission from the "King of Forvick"? 3. When will there be a music and cinema venue built - cos the winters can be fairly lang and miserable in Papa Sound and some form of entertainment is a must at that time of year? 4. Does the "King of Forvick" refuse his State Pension now - and when we become citizens must we also follow that lead? 5. Can I open a post office on the isle? 6 .... and of course the first of many pubs- whats the licensing hours? 7. What is the National Dress? - hats with birds wings or horns can be smart;) 8. Will we have to drive on the left or the right? 9. Will it be a 9 or 18 hole course? 10. Who's going to live at No. 10? 11. More importantly - who's in No. 11? 12. ...... ok disciples - you know there will be some takers .. but who? 13. Is there any chance that we could have 13 Elephants - you know a dozen or so to help with the toil? 14. ............. there is no 14 because until the school is built we can't be sure that numeracy will thrive. . On the subject of ownership, and Stuart Hill's claim that he "owns" Forwick Holm...Forwick Holm is part of Forwick croft. That it is an islet is irrelevant. While you can decroft a croft house and its grounds, to my knowledge what you CAN'T do is subdivide croft land and sell off individual parcels. I notice that Stuart Hill is very careful to say he has “acquired†the land, interestingly, as far as I am aware, he has never used the words “bought†“leased†or “had giftedâ€.So if the authorities such as the planning department or crofters commission did have an issue, presumably they would take it up with the registered land owner, and not Mr Hill?This would also mean he has no legal right to sell off parcels of the land either? Why, that would almost be scamming!I don't pretend to be an expert in crofting laws, and am happy to be corrected. Launch from Sandness, set ashore on Forvik, depose the leader with reasonable force (perhaps some stern words would suffice), burn the village....er, tent and plant a flag upon it's godless soil in the name of shetlink, naming the new land Shetvik! I can supply names and addresses of numerous crofts to which this has been done in the last 35 years or so. 2)I don't know if he's ever said "acquired", but he has said: I have recently become the owner of a tiny island off Papa Stour http://shetlandconversation.squarespace.com/forvik/ Additionally, the croft of which Forewick Holm was/is part of need not necessarily have been registered with the Crofters Commission, it is not, nor has it ever been obligatory to register a croft. If it isn't the Crofters Commission has no power whatsoever over it. However, if it is part of a registered croft, the Crofters Commission have, or at least had a legal obligation to "ensure the land was being used productively and responsibly for croft purposes", or words to that effect. The Crofters Commission have no powers concerning who owns a registered croft, their powers are entirely concerning who occupies the croft. Worst case scenario: If Stuart Hill *is* the owner, and the Holm *is* part of a registered croft, the Crofters Commission cannot prevent him from owning it. What they can do though is prevent him from occupying it. Yes, in theory at least, if they ajudge that he is not using the land in question for legitimate crofting purposes, they could evict him from his own island, and put in a tenant of their choosing. In practice, it rarely happens, and I very much doubt they'd be too concerned concerning a tiny Holm in the Atlantic which is of negible agricultural use anyway. Of course, the above relies on Scots Law to enforce it, and seeing as "Forvik" is no longer part of Scotland....ahem....one could be tempted to say that Mr Hill maybe will have his day in court to argue over Shetland's Constitutional rights after all, in a case brought by the Crofters Commission.
