DavieG Posted August 2, 2006 Report Share Posted August 2, 2006 Hello Folks Have just heard that the Home Office are NOT going to appeal against the judical findings so it would appear that Sakchai's ordeal is now finally over. In their release they say that they will continue to seek the deportation of individuals under the current legislation but that it will be ultimately be up to the courts to make the final decision and they will respect that, as they have done on this occasion. So great news and thanks again to EVERYONE for your quite incredible response to the campaigns call for assistance, which still staggers me when I think about it. Each and every one of you helped bring about this result and you and Shetland in general should be more than proud. As the judge said in his initial submission the community response had played a significant part in his / their decision making process so you see we CAN make a difference, and how!!!! Thanks from the bottom of our hearts again and will keep you updated re any further developments, especially the management of the fund(s) now that we can finally start to wind things up. It's amazing what can be achieved when we pull together what will happen to an application for citizenship?Sakchai said on Radio Shetland tonight that he has to wait before applying because of the recency his convictions (please correct me if I'm wrong. If so then that is surely another example of bad government. I bet if the decision had gone the other way the media would not have been told until after another heavy squad had been sent from the mainland to lift Sakchai and spirit him away to some holding centre. Is there a next step now? The next step is for Sakchai to secure himself UK citizenship but he has to wait for a while until the 'wake' from his conviction dies down so to speak. The HO guidelines on this are ambigious (now there's a surprise) and we are looking at this at the moment to see just when he can stabilise things for himself citizenship wise. We are also in the process of winding up the formal campaign and looking at settling the legal cost with all concerned. Full and formal details of this, the campaign fund involvment and any surplus relating to this (which is not likely to be much if anything I can assure everyone) will be published in due course. Meetings in this respect will be held the week after next with all the SfS fund 'managers'. From a personal point of view I am now involved in helping out another similar campaign, while also seeking way(s) we can put pressure on the HO to change thier immigration policy in light of ALL the flaws highlighted during the Sakchai campaign and beyond. However it now seems they may be trying to tighten up current legislation and guidelines even further, presumably to avoid any possibility of future embarrasments to THEM of the Sakchai kind in the future - but almost certainly to the detriment of many of those they continue to 'hunt down' in this respect. On the surface they are saying that each case will be considered on its individual merits by the judiciary, but if they give that judiciary less room to manoeuver in this respect in the future..........!!!!! Anyway I will try to keep you up to date with any developments and once again a massive thank you to eveyone for all your help, support and kindness.
