It's Shetland Fudge and Shetland Fudge alone who are causing the trouble. If you read the Shetland News article it's obvious(states) that Burra Bears recieved a threatening legal letter from Shetland Fudge which, as Burra Bears says, left her with no choice but to seek legal advice. So I'm afraid it's plain wrong to tell them both to "just grow up and get on with it". Mrs Burra Bears is one of the friendliest and most decent people you could ever meet. So fudge lady asked burra lady not to use her company name on the web site... so what? Isn't that reasonable? She said she had no problem with Mrs Inkster using the terms Shetland Teddy Bears or The Original Shetland Teddy Bear, which appears on all Burra Bears’ labels, she just wanted to protect the name The Shetland Teddy Bear Company. Most folk just wouldn't create something that is already a concept designed by someone else, especially something so unique...Its a matter of respect. Was there not a shop in Lerwick who stocked Bloo Coo Ice Cream then started up in competition when they saw it was a good thing? Still it doesn't look like either are going out of business, can't they both coexist? (Reminds of the Bucks Fizz name saga!) What if someone else wanted to make Shetland cheese or island shaped earrings? But...I'm not convinced that using a web domain incorporating the trademarked name to redirect traffic is covered by trademark legislation.
