BigMouth
Shetland News reported that: - "Sheriff Philip Mann deferred sentence until 18 March for reports, saying it was a serious offence to carry a knife in public". I find it hard to believe that the Sheriff is that ignorant of the law, so I assume that the words of the Sheriff have been misreported. You may carry a folding pocketknife if the cutting edge of its blade does not exceed 3 inches (without having to have a reason). You can carry fixed blade knives, or folding knives of a longer blade length with certain reasons: use at work, religious reasons or as part of a national costume. In this case the accused was carrying a blade in excess of this, so was breaking the law. Knives and drink don't mix. Threatening behavious with even a legal carry knife will get you nicked. paulb
man still on trial sorry but we should not be doing this yet. he may be innocent even.
Suffererof1crankymofo
paulb, he pleaded guilty. "deferred sentence" might not apply in this case but rather "adjourned diet". Edit: It's not like the sheriff said "you behave for 3 months and we'll let you walk". Deferring sentence is accepting the guilty plea; it's not a trial in the sense of proving innocence or not. (From the Judiciary of Scotland website) Deferred sentence A form of sentence in which the final decision about any punishment is deferred or put off to another date, usually some three to 12 months later. Where sentence is put off for a few weeks for further information, such as social enquiry reports, this is not a deferred sentence, but is properly called an "adjourned diet". Colin
I think what Paul means is; that any discussion might possibly influence any sentence that is eventually passed. Either way, I bet he doesn't get 3 years....
paulb
i understand what your saying. we were told in no uncertain terms that to talk about a case before sentence is a very serious no no. we were advised to shut up if they were wrong so be it. but the person has not offered their mitigation. ok i withdraw innocent just reread what i wrote. Popular Post Scorrie
It is the inference that Shetland only suffers violent crime at the hands of 'outsiders' that hacks me off, Colin. Ain't saying that it's all a bed of roses with folk coming in. For example: Vicious assault in the Toon back end of last year? Home grown. Knife assault in Brae recently? Home grown. Man brandishing weapon in public? Home grown. Man entering house and threatening to smash terrified womans face in? Home grown. Check the court cases every week and repeat ad naseum...... Colin
Fair comment I suppose (and agree) but Shetland has become a bit of a 'destination' for "reprobates, renengades and runaways" of all sorts in the last few years and, it is no surprise that a good percentage of them become 'known' to the authorities.A lot of these people have little (or no) respect for themselves, never mind others. In addition to this, we also seem to have imported a lot of 'bad attitudes' and, how would you address these? I have no idea.
Scorrie
Indeed, there seems to be a mindset amongst some of the more, er, 'troubled' members of the UK community that they can move to quiet areas and disappear. Completely the opposite is true. A troublemaker will always stand out more in a small community than in a big UK town, a concept that appears to be lost upon them. As for the 'bad attitudes' - same here Colin, haven't got a scooby about what to do about it. But maybe a good kicking would help......... Kavi Ugl
There are many good people who have settled in Shetland and who contribute to life here but we have to admit that we do seem to attract a lot of "problem people" originally from sooth. Or people who think they can do as they please while here. This is from Jan 2014-Feb 2015.......
