Nah, he’ll just have attended an away day, brain storming session with joined up blue sky thinking and a helicopter view (forgive the pun),forgetting to touch base with the general public and interested parties.
He forgot to cascade the information and get all his ducks in a row with this one...

Spoken like someone who makes statements which he thinks makes his points more credable, without knowing whether what he states is correct or not.

The heading of this topic is “barred but apparently blameless” but It’s unfortunate that some people only see black or white, but it’s not as simple as that. To go back to the heading the drunk! person has responsibility for his actions and his actions led to him being asked to leave, he didn’t and was eventually escorted off the premises. I have no issues with this what so ever.
 
Then he was shoved resulting in him falling and breaking his wrist. This is where the grey area exists, as I was not there I didn’t see how he was shoved, was it a gentle push to remove him from the door way or was there anger and aggression above what was required to remove him. I don’t know the answer, but it seemed there was enough doubt for it to end up in court.
 
I do not believe that the outcome was intended, but we could say that about just about anything after the fact. In hindsight would the member of staff take the same action again, I doubt it. Regardless of the reasons, once we lay hands on another we risk prosecution regardless of our intentions.
 
Was the ‘drunk’ blameless. No and I think he should have been dealt with by the court as well.
 
As for pleading guilty to get an reduced fine etc, I’m sure this will happen, but if you are innocent a good lawyer will advise you to stand your ground and fight your case. I’m sure your lawyer will have a discussion with the sheriff as well before the case starts.
 
This isn’t a simple black, white issue, it’s full of gray areas, unless you were there you don’t know the details.

I don’t think this is about ‘everyone is nice and fluffy’ it’s about what we are allowed to do within the law, it’s to do with taking the law into your own hands, and this is something that, if allowed to happen can blur the boundaries. Where do you draw the line.?
 
You say ‘not through the direct malicious actions by the barman’ well perhaps he was not malicious, but he decided to take direct action, which resulted in the injury of someone else. The judge was right that an offence was committed, and could have also removed his licence, however I would think he carefully weighed up the circumstances of the case and accepted the the injured party had some responsibility in the case.
 
Whilst I have every sympathy concerning the difficulty and stress related to the job of doormen, it is clear that they undergo comprehensive training to deal with these situations and they are required by law to deal with them in accordance to the rules that govern at the time.
 
In the olden days we would have just taken this chap outside and taught him a lesson, but today this is not only frowned on but would put ourselves at risk of prosecution. Had the police been called, it would have been the other party facing the judge.
 
I for one would not have the patience to deal with drunk annoying, mouthy people, which is why I would never become a doorman, but those who do choose this line of work must carry it out in full accordance with their training and the law. I remember the olden days where untrained body builder doormen dished out thumpings to idiots who were too drunk to defend themselves, thankfully things have moved on where doormen are concerned. Unfortunately there are still far too many drunk idiots.

The town centre is suffering from high rates, impossible access (squared off speed bumps)  & limited accessible free parking - this is killing off the local business's. Until these problems are addressed, folk will go elsewhere.

^ As a potential shopper, I look for convenience and accessibility when it comes to checking out if what I'm interested in is stocked on the street, and at a reasonable cost. What the place looks like, and gimmicks aren't going to affect it one little bit.
 
The old taxi rank at the back of Anderson's has long since been blocked off behind a silly little wall, Irvine Place/Harrison Square is now largely if not completely closed to vehicles I understand, the back of the old Medical Hall now seems mostly taken up with tables and chairs belonging the Peerie Shop cafe most half decent days, they allowed M&Co to build over what was behind that shop, they're blocked off Burns Walk to vehicles and wasted everything at the back of the Bank to some arty farty supposed bike rack and a few seats. So basically, from the Cross to Charlotte Street convenience and accessibility has gone right down the tubes compared to what it once was - that doesn't leave much street to be going on with.

Doesn't look promising. You wonder why someone in England is trying to sell cars way up here.?
 
They have been advertising cars on here for some time without paying the commercial advertising rate. Let's hope no one up here has been sold a banger, which might be a danger to themselves and other road users.
 
Plenty of cars at the local garages. I bought an older car from a local garage which came with a full years guarantee and it was honoured without question when I had problems. Better to deal with someone who you can meet face to face and has to live in the community.

And what do you think the SNP will do to balance the books if it ever gets its way with independence. They could not convince people an independent Scotland could be financially viable last time, never mind this time with much reduced oil revenue. If you think moneys tight now, god help us if they ever get their way with independence. What they're left with will all go on the central belt, Shetland won't have a look in. 
We may not all agree with Alistiar Carmichael, but he's our only hope of keeping the SNP out of Shetland.

Aberdeen played Celtic last weekend I think it was,the team with the highest score won as is normal and if my memory serves me right that was Celtic.

Surely the buchan alpha announcement is brilliant news! Especially coming so soon after the Dales Voe development being completed. Thankfully the SNP didn't get their way over abolishing HIE or this and many other projects might never have got off the ground.
 
There's not many major projects been awarded yet so this coming to lerwick will hopefully be the start of many.

Your right about them being a good buffer Capeesh and if they would get on with the day job, they would likely get my vote. It's the "independence at any cost and regardless of those who have already said we don't want it" that worries me. Scotland can't afford to be independent. If she got her way you would soon see the real side of the SNP, a country struggling to make ends meet, higher taxes and loss of services. Of course it would be someone else's fault. 
I listen to debates both Westminster and Hollyrood and whilst some impress me others are about avoiding the issue like most politicians. Watching Alex Salmon on TV the other day avoiding the questions and shouting over the presenter to put his independence at any cost position across, made me wonder if they are living in the real world. His answer to the question regarding dropping education figures was that Scotland has the least youth unemployment of most countries. Well that's great, more have a job, but they're not so bright!!. That bods well for future development.
 
As a government I think they have got their priorities wrong and it's having an effect on the stuff they should be looking after. If they would put independence to one side and prove they can do a great job of running the country, they would likely get more votes, make the country more prosperous and who knows what the future might bring. But as long as they can't get past the independence at any cost attitude, they will not get my vote and I believe many feel the same.

It is laughable, but also worrying, that this unelected group of people can fill the trust with whoever they wish and control the people of Shetlands money.
 
I though one of their arguments for appointing trustees was they could get the right experience on board, If this is the best they can do then I can only assume it's just jobs for the boys or we will appoint those who fit our agenda.
 
Personally I am very concerned as to where this trust is going and that we now have a self appointing group of people who seem to crash ahead without taking on board the concerns of the community. It makes you wonder what their future agenda is.
 
They have already proved that they will just do their own thing regardless of public concern.

Having read through this thread and at first thinking, this is just too big for us, I must say that I am impressed with the answers that have been given to lots of the questions raised. The debate has remained grounded and this is not just pie in the sky stuff.
 
Yes, there are lots of unanswered questions and there will be lots of hoops to jump through and neither Westminster and Hollyrood are going to make this easy. Hollyrood in particular will not want to see the goose that laid the golden egg get out of their grasp.
 
Difficult it may be, but so are the alternatives. Remain as we are and the likelihood is we will be dragged into an independant, centralised Scotland, and once the Scottish government has complete control over us, we will be lucky if we get the scraps of the table. The stories of Vikings robbing and pillaging us, may be fact or fiction, but the stories of both the UK and Scottish governments doing the same are happening as we speak.
 
So yes, I think it's time for something different and time to take control over our own destiny, rather than be dictated to by folk that have their own agendas at the forefront and not the interest of Shetland or its population.

Of course there is no costs involved with arranging another by-election
 
The guy was caught, has apologised and let's be honest, it's not the worst crime in the world. he allowed his aid to leak a memo, he didn't break her legs. There all at it. Find me a politician who hasn't twisted something or told white lies at some time.

Come on now Capeesh, your not fooling anyone. You can hardly wait to constantly spread the news on here, news that we are all capable of reading and noticing ourselves. A bit like an ald gossip .
It's just a pity that folk seem to enjoy to hang, draw and quarter someone on public forums rather than let due process take its course, and in addition seem to get so much satisfaction out of other people's troubles.
 
You say you won't make the mistake of voting lib/dem again, I can only assume from that statement that you believe any future lib/dem candidates cannot be trusted, a rather strange view to take.
 
I don't know who you support, but I'm assuming it's SNP. Perhaps you should start judging some of their tactics and if you believe that the party is responsible if an individual member misleads the public, you won't find any parties left to vote for
 
I'm all for action to ensure our politicians are above board, but I think this case has been blown out of proportion, clearly for political purposes.
