  1. Below are all the emails (newest at the top). I reckon I could complain a bit more about how the TV had an inherent fault that only just appeared, but instead I'm gonna take the £75 refund and put it towards getting it fixed by Tam Dalziel.. Mainly because I think they'll first want an engineer to confirm it's a physical fault that's always been there and that'll involve either sending it away/paying someone local to say so, and I'd rather just get it fixed asap without involving mailing it south or anything. ------------------------------------------- Dear Mr Tait, My name is Peter Johnstone and I represent Executive Customer Relations within Amazon.co.uk and in this capacity, your correspondence has been brought to my attention. I am sorry to hear of the difficulty experienced with the "Toshiba 40RV753B 40-inch Widescreen Full HD 1080p" received on 7th Jul 201 from your order # 203-7945699-8027525. The European Directive 1999/44/EC allows for a claim to be taken (under certain circumstances) for a period up to two years in accordance with European Law, and up to six years under UK law. This does not imply that an item has a warranty of two years or six years respectively. It merely permits an individual to make a claim under certain circumstances within that time period, e.g. should a fault be proved to have been inherent in the first six months. Amazon do not provide the warranty for this item. We do, however, cover our obligations under the relevant legislation such as the Sales of Goods Act 1979 in the UK. Under the Sale of Goods Act, a consumer is granted recourse against a seller of goods if those goods were defective at the time of purchase. This may include, in certain circumstances, repair, refund or replacement but only to the extent that doing so is not disproportionate to the value of the goods, having regard to the use the customer has already had of the goods and the nature of the goods. You purchased your product approximately 15 months ago and, until recently, have used it successfully and reported no fault with the product. Given your satisfactory use of the product for a period of time which exceeded the manufacturer's warranty period, it is not established that the product did not conform to the contract (i.e. was defective) at the time of purchase. Amazon.co.uk is therefore not under an obligation to offer any additional assistance in repairing or replacing your product. However, although we do not have any obligation to do so under the Sale of Goods Act or otherwise, in this circumstance as a measure of good will we would like to offer you a choice of the following resolutions: 1. An Amazon.co.uk gift certificate to the value of 100 GBP. 2. A refund of 75 GBP. Please reply directly to this e-mail to confirm if you wish to accept either of these offers as a full and final settlement in this matter and I will make the appropriate arrangements. Thank you for your attention to this email. Regards Peter Johnstone Executive Customer Relations Amazon.co.uk http://www.amazon.co.uk ========================== ---------------------------------------------------- Hello Amazon.co.uk, Thank you for your timely and helpful reply. I have since been made aware that my concerns regarding the Sale of Goods act should actually be raised with the Retailer and not the manufacturer, so I now believe my request for repair should be lodged with yourselves. I am aware that the warranty has run out but I believe my rights gained from the durability section of the Sale of Goods act state that items bought should last for a reasonable amount of time. If you are willing to discuss what a reasonable time for an LCD TV to work for is then I would be willing to do so, though I think we can both agree a year and a half is not reasonable for a £500 purchase. I has read from manufacturers that 6 years is a reasonable amount of time for their TVs to last. I got under a year and a halfs use out of a £500 purchase that aparrently should have lasted 6 years. I have essentially gotten £125 use out of my purchase, which is upsetting but leads me to another point. I'm not sure what your preferred actions are in these situations, either repairing my TV, replacing it with a likewise model or paying my fee's to get it repaired locally. I would like to present another option if your procedures can cope with 'side deals' as it were. Since I got £125 of use out of a £500 purchase I am essentially out £375. I propose that I send the TV back to Amazon, where it can be refurbed or whatever you deem necessary, and refund me £300. I chose £300 instead of the £375 I feel I've lost out on because I consider myself a reasonable man. In fact, I would be happy for this £300 to be in the form of an Amazon.co.uk voucher as I currently plan on replacing the TV with one from Amazon.co.uk. I realise as a large company you may have fixed procedures that don't have any leeway, but still, it's another option, and one I would prefer as it cuts out a lot of the hassle and correspondence from the situation. I look forward to hearing from you again, Duncan > Date: Tue, 4 Oct 2011 21:00:37 +0000 > From: cs-reply@amazon.co.uk > To: dunctait@hotmail.com > Subject: Your Amazon.co.uk Enquiry > > Hello Mr Duncan > > I am sorry that you are not happy with your purchase. > > We're sorry to hear of the issues you have experienced with the "Toshiba 40RV753B 40-inch Widescreen Full HD 1080p Digital LCD TV with Freeview HD" you purchased from us. > > All electronics item purchased from Amazon.co.uk come with a 1 year warranty from the manufacturer. 2. I've sent an email first off to amazon mentioning the sale of goods act and requesting a repair/replacement/partial refund. If there's any success with that I'll post the emails for y'alls information
  3. I am aware of his mad skillzez, though I was recently told he no longer fixes things that people take in off the street. I think it was maybe because he's quite busy with the work the cope give him already if i recall correctly
  4. this is my plan actually if they give me any hassle its a toshiba tv i got from amazon.co.uk. i imagine amazon wont be interested in doing anything about it so ill call up toshiba today
  5. anyone know if its possible to get an lcd tv repaired in shetland? cost £500 just a year and a half ago so i dont feel like getting a new one
  6. when i used to buy smokes from don leslies last year i used to get completely the wrong change back so i was buying a £7 pack for like £3. a+++, would shop again
  7. it is ridiculous that most of their 'hacks' were based on sql injection. I've made a couple of websites for advertising the most minor things (in comparison to the cia/soca) and the first thing I do on a contact page is check that escape characters are removed from any data i guess lulzsec are right to say so many sites have terrible terrible security, which i think their original point was to point this out in as humorous a way possible. then they got a lot of attention and tried to be more mature and pretend they were hacking for a cause, when they really have no specific cause. how can they claim that topiary was politically motivated when his motivations against hacking each site are all over the place? also i still dont get the fascination with nyan cat
  8. I thought Topiary wanted to steal someones name to potentially frame them somewhere down the line so he took the name from this Shetlander who was being annoying on the internet..? That was my understanding of it. And I prefer it that way because it means someone got arrested for being an ass on the internet and that should happen more often Also I'm inclined to believe they got the wrong guy simply because sabu is posting all over twitter that they got the right guy and if a) it's the real topiary then they'd be too smart to admit that he has involvement with lulzsec in such a public place and if it isnt the real Topiary that's been arrested, then they probably think theyre really smart by playing along with it in public, and then the real Topiary stopping all public internet activity I like some of what they do, and the Westboro Baptist Church deserves everything it gets, and I am also impressed at their technical skills, but they still seem like self obsessed immature idiots to be honest
  9. While I don't care about commenting on the rest of this thread I think the quote above is a ridiculous statement. My opinion is that it is untrue, but we can at least all agree it is a generalisation. Why not just go the whole way and say "people would complain about mild mannered drug users going about their business quietly but would watch less mildly mannered people who like more socially acceptable drugs murder and rape without complaining or saying society was broken"
  10. I actually went through all the edits to find when that was added to his wikipedia page (since all mentions on the internet refer to the wikipedia page, which has no citation). Anyway I found it eventually: 16:17, 29 July 2009 84.246.168.11 (talk) (24,113 bytes) (→Personal life) Looking at this guys 'talk' page, he's been cautioned for vandalism (and seems to have something specifically about gay people): http://en.wikipedia.org/wiki/User_talk:84.246.168.11 So screw that guy, I'm gonna request it gets removed for lack of citation

    Posers

I know a lot of people go to Posers about half10, get a stamp then go to the pubs for two hours. Then they go back and can walk straight in. You can do the same thing at the Wheel if you go there after 12 when they start charging to get in. Then people stand out the front and smoke so the bar staff knows who has already paid in, so they can just walk in.

    Posers

The Wheel and Posers are both legally Clubs, that means they have to charge people on the door after a certain time and have people manning the entrances too. That's the only way to get a 2am license, which sucks compared to the old 3am licenses that seemed to be everywhere. Anyway they're strict about it because if not they can lose their license and that's a big deal
  13. plusnet are no use for p2p. if you care about that.
  14. Its an interesting read, but its fairly well documented that a lot of the recipes are useless and/or outright dangerous to follow
  15. I honestly think that kids are a lot more resilient than many Shetlinkers give them credit for. Having to travel further every day won't damage the kids in any huge way, and it will save massive amounts of money that can ultimately be spent to improve our community in other ways.
  16. I reckon everything in the world will work out fine and we don't need to worry about anything.
  17. that was my favourite bit too, i wish i could remember the joke he said just before it that made everyone pause for a second
  18. it really really really honks downstairs. me and a mate were talking about voting it the worst toilets in shetland, let alone shetland pubs, just the other week
  19. yep. I was using it about half an hour ago outside of the town, but once i got into town then my phone constantly says "error in connection". i still get the bars and whatnot, just cant make calls.
  20. Out of interest, do you mind someone else profiting off of your mothers grief/illness/whatever if you don't personally believe it? I can see how you would do anything to give her comfort/hope, but personally it would leave a bad taste in my mouth if I thought it was all fake
  21. yeah but you cannot rush perfection which is why we're still waiting for Duke Nukem Forever.
  22. If you're asking the question then the 360 is for you. What it all comes down to is the 360 is a more casual experience, compared to the PS3
